マレーシアとオーストラリアが自由貿易協定に調印  TPP交渉の遅れをみこして錯綜する自由貿易協定

 交渉参加をめぐって国内で政治問題化しているTPP(環太平洋経済連携協定)だが、交渉加盟国のうちの二カ国が一足先に自由貿易協定を締結するという動きがある。マレーシアとオーストラリアの自由貿易協定MAFTAで、5月22日に調印された。MAFTAは7年越しで交渉されていた経過はあるが、なぜいま急きょこうした動きになったのか。オーストラリア公正な貿易と投資のためのネットワーク(Australian Fair Trade and Investment Network)のパトリシア・ラナルド博士(Dr Patricia Ranald)はその論文で「今年中にTPPは締結されないかもしれない、という徴候であると推測できる」と述べている。協定文書は今後条約に関する共同常任委員会にて審議されるが、オーストラリアの市民グループは貿易協定が署名される前に文書が公開されることを求めている。日本の市民グループ「TPPに反対する人々の運動」のニュースレターとウェブサイトが伝えた。(大野和興) 
 
 ラナルド博士は両国のFTAの特徴を次のように分析している。 
(1) 貿易協定の重複:MAFTAのほかオーストラリア・ニュージーランド・ASEAN自由貿易協定とTPPという三つの独立した貿易協定が生まれるが、このことは貿易を容易にするという目的に矛盾する可能性がある。 
(2) TPP交渉が年内に間にあわない可能性があり、MAFTAが急がれたのは早い関税削減という結果を得たいという自由貿易に強く傾斜するオーストラリアの意向が働いていると推測できる。 
(3) 2020年までに全製品の99%を無関税にすることになおり、民間による教育、情報通信、保険に対する投資規制も緩和されるかまたは取り除かれる。 
(4) オーストラリア労働党は貿易協定に強制力のある労働権と環境基準を盛り込もことを約束しているにも関わらず、労働と環境に関する章が欠如しており、TPP交渉にゆだねられることになっている。MAFTAは労働者の基本的な保護もなく、ゼロ関税へと突き進んでおり、賃金や労働条件の底辺への競争を推進するものとなっている。 
(5) 協定にはISD(投資家対国家間紛争)は含まれていない。これは、TPP反対のキャンペーンで有効活用できる。

This is a short, non-technical summary of the main features of the agreement done for the AFTINET Bulletin. The Malaysia-Australia Free Trade Agreement (MAFTA) was signed on May 22 by both countries’ trade ministers, completing negotiations which began in 2005. According to the Australian government, the purpose of the agreement is to have faster tariff reductions and greater market access for Australian goods than are contained in the Australia-New Zealand-ASEAN free trade agreement, of which Malaysia is also a member. And of course, Australia and Malaysia are also involved in the Trans-Pacific Partnership (TPP) negotiations, which include the US, New Zealand, Malaysia and six other countries. If the TPP is completed, Australia will have three separate trade agreements with Malaysia, each with different conditions, which seems to contradict the stated aim of making trade easier.

So why the sudden hurry to complete these negotiations after seven years? We can speculate that it is a sign that the TPP may not be completed this year, and that the Australian government, in keeping with its strong ideological commitment to zero trade barriers, wants to have some results on the board which give faster tariff reductions than those achieved in the ANZ-ASEAN FTA. The agreement is expected to be implemented from January 1, 2013. 
 なぜ、7年も経って突然急いでこれらの交渉を締結するのだろうか?今年中にTPPは締結されないかもしれない、という徴候であると推測できるだろう。また、関税障壁を皆無にしたいという強いイデオロギー的傾倒を持ったオーストラリア政府は、オーストラリア・ニュージーランド・ASEAN自由貿易協定で達成されたものよりも早い関税削減という結果を得たいのだ、と推測できる。この協定は2013年1月1日に発効する。 
 
Australia has agreed to give tariff-free access to all Malaysians goods from the implementation date, and Malaysia will give immediate tariff free access for some products, and for 99% of all goods by 2020. The main advantage for Australian industry is that Australian car parts and large cars will have tariff-free access to Malaysia from the implementation date. Restrictions on investment in private education, telecoms and insurance have also been reduced or removed. These measures reflect the ideology of zero trade and investment barriers which serves corporate interests, but can have negative effects on local employment and governments’ ability to regulate services in the public interest. The most glaring omission from the agreement is the lack of labour and environment chapters, despite the fact that Australian Labor Party trade policy in December last year contained commitments to include enforceable labour rights and environmental standards in trade agreements. Side letters to the agreement state that the two governments will implement what emerges on labour and environment in the TPP negotiations, but this may not happen. The ACTU has condemned this failure to implement the government’s policy

However, some aspects of the agreement are more positive, in that they do not have some of the worst features of the neoliberal models of trade agreements. Importantly, the Australian government has kept to its policy of not giving international investors the right to sue governments for damages, so there is no investor-state dispute process in the agreement. This is a positive example which can be used in our campaign on the TPP.

The services chapter uses a positive list approach, which means it includes only those services which each government intends to include, rather than a negative list which includes everything unless excluded. Government procurement is excluded from the agreement. The intellectual property chapter does not contain the harmful provisions to extend patent rights on pharmaceuticals which are in the US-Australia free trade agreement, let alone the extreme measures which the US has proposed in the TPP. However, the agreement does contain stronger provisions on copyright and stronger measures for enforcement of copyright and intellectual property rights more generally, including criminal penalties.

Overall, the MAFTA pursues a course towards zero tariffs without basic protections for workers’ rights, which we know will encourage a race to the bottom on wages and conditions. It also contributes to the “noodle bowl” of confusing overlapping agreements in our region. However, the fact that it does not include some of the most extreme measures on investor rights and intellectual property rights provides some useful examples for our campaign against them in the TPP.

It will now go to the joint Standing Committee on Treaties, but Parliament does not debate the treaty text, only any legislation which is required to implement it. We repeat our call for the text of trade agreements to be released publicly before they are signed. This call is increasingly being made by journalists and others frustrated with the process.
